On the 8th October, 2015 the Environment Agency published its approach to enforcement of ESOS in its Enforcement and Sanctions Guidance.
Some key points to note from the newsletter from organisations that have to comply with ESOS are:
- The legislation hasn’t changed. The deadline date is still 5th December, 2015.
- The Environment Agency as the regulators have the “ability to exercise discretion when taking enforcement” although it’s important to note they do not guarantee to be lenient for those who miss the deadline date.
- For those organisations that make late notifications the Environment Agency expects them to “keep records in their evidence pack of their efforts towards ESOS compliance, including appointment of a lead assessor, prior to the deadline.” This highlights the importance of hiring en ESOS assessor and keeping records before the deadline date if you’re likely to miss the deadline date but looking for leniency.
