The deadline for ESOS Phase 3 compliance is the 5th of December 2023.

The data preparation period began on the 1st January 2021 meaning it’s time to act.

  • The deadline for ESOS Phase 2 compliance was the 5th of December 2019.
  • You should have submitted your ESOS Compliance Report by the deadline.
  • If you haven’t you might have received an ESOS Enforcement notice. If you have, contact us ASAP so we can assist you.
  • Failure to comply with ESOS can lead to fines of up to £50,000 and public disclosure of non-compliance.

What is ESOS?

ESOS is the Energy Savings Opportunity Scheme and it was introduced by the UK Government to promote energy efficiency. The scheme was designed to ensure large enterprises are regularly assessing their energy usage every 4 years and, most importantly, to highlight energy savings opportunities as a mandatory practice. The next deadline for ESOS (Phase 3) compliance is the 5th December 2023.

How long does it take?

The take it takes to comply with ESOS varies from company to company. Each ESOS audit is different, that is why at Enistic we offer a free scoping meeting in order to fully understand the size and the needs of the organisation. From that meeting, we will be able to provide you with an estimated timing for your ESOS journey.

With over 10,000 companies needing to comply, it’s important to stay ahead of the competition and begin the route to compliance early. Failure to comply in time can lead to fines of up to £90,000.

How do I know if I need to comply?

Any organisation meeting any of the following criteria MUST comply with ESOS:

  • Have over 250 members of staff.
  • Or turnover of over 50 million Euros (£43 million) and an annual balance sheet total in excess of 43 million euro (£37 million).
  • Or be a part of a larger organisation that falls into either of these categories.

What's required to comply with ESOS?

On your ESOS report, you will need:

  • At least, the data regarding 90% of the energy consumed by the organisation has to be accounted for across all sites, including transport.
  • Must use 12 months’ verifiable data.
  • ESOS Assessments must be reviewed and signed off by a Board-level Director, and approved by a Lead Assessor and then reported to the Environment Agency.
  • Energy audits need to be conducted and data submitted every 4 years.
  • Failure to comply with ESOS can lead to fines of up to £50,000 and public disclosure of noncompliance.
