Have you received an ESOS Enforcement Notice?

If so, it likely means your organisation did not submit an Energy Savings Opportunity Scheme (ESOS) report by the required deadline. These notices are issued by the Environment Agency to companies that fall within the ESOS scope but have not demonstrated compliance.

All qualifying organisations must complete and submit an ESOS report every four years. Failure to do so may result in enforcement action and financial penalties of up to £50,000.

In many instances, current Enforcement Notices relate to ESOS Phase 3, which had a compliance deadline of 5th Decemebr 2023 (extended to 6th August 2024). Please note that ESOS Phase 4 is now underway, with a submission deadline of 5th December 2027.

What do I need to do?

First of all, DON’T PANIC.

If you have received an ESOS Enforcement Notice, you should act ASAP to get compliant.

Lots of ESOS Enforcement Notices include an extended deadline for your company to submit the compliance report. Nonetheless, if you don’t comply by the deadline the Environment Agency will issue you with a penalty.

Who qualifies for ESOS?

If your company is classed as “large” in accordance with the Companies Act 2006 you will need to carry out ESOS compliance and provide a report by the stated deadline (next deadline, for Phase 4, is the 5th December 2027).

Any organisation meeting any of the following criteria MUST comply with ESOS:

  • Have over 250 members of staff.
  • Or turnover of over 50 million Euros (£43 million) and an annual balance sheet total in excess of 43 million euro (£37 million).
  • Or be a part of a larger organisation that falls into either of these categories.

Frequently asked questions – ESOS and EAPs

When do I need to submit my ESOS report?

The deadline for ESOS Phase 3 compliance was 5th August 2024. If you didn’t submit your report and you are required to do it now, please call us ASAP. Our in-house ESOS Lead Assessor can help you.

The deadline for ESOS Phase 4 compliance is 5th December 2027.

What happens if I don't comply with ESOS?

If you don’t comply with ESOS you will be at risk of being fined. You will be charged a fixed penalty of £5,000 plus an additional £500 per day until you submit your ESOS report. As ESOS is a public report, not complying with it could also damage your reputation.

Will ESOS Phase 4 include more information?

It is expected that you will need to include more information about your carbon emissions on ESOS Phase 4 (e.g. a wider analysis of your Carbon Footprint, a Carbon Reduction Plan, and Net Zero assessments).

Do I need an ESOS Lead Assessor?

Yes, to legally comply with ESOS you need a qualified ESOS Lead Assessor to sign your report.

What happens if I don't have all the data for ESOS?

It can be complicated to get all the data required for ESOS, but it is a legal requirement that you get it. Here’re some things you can try:

  • Checking with finance teams for invoices.
  • Contacting the utility provider for usage details or online portal access.
  • Requesting an FTP data download if necessary.

Can I generate legally compliant reports from the Enistic system?

Yes. We have produced and filed over 4,000 fully compliant legal reports. The system is tried and tested and 3 of the Big 4 accountancies have audited the reports over the past few years. 

What standards does the Enistic software comply with?

The Enistic software is heavily standards based and complies with most standards that you will need in day to day use. This includes: ESRD, ISSB, IFRS S2, CSRD, ESOS, SECR, Science-Based Targets, GHG Corporate Accounting Standard, PPN 06/21, GHG Corporate Accounting Standard Including Value Chain, ISO15804, ISO1404, ISO20121, BS:EN 16274, and ISO5002.

Is the system available in languages other than English?

The Enistic software is available in English, French, German, Italian, Spanish, and Simplified Chinese.  If you need another language, please contact us to discuss.

How many factors are built into the system?

Enistic maintain a large database of UK and EU government approved conversion factors.  There are over 40,000 factors built in, including in the software that cover fuel types, vehicle types, energy types, product composition, raw materials, and company annual emissions.  Factors are updated promptly if annual updates are issued by the relevant authorities.
